{"id":637,"date":"2022-11-11T18:15:00","date_gmt":"2022-11-11T18:15:00","guid":{"rendered":"https:\/\/paperprisons.org\/news\/?p=637"},"modified":"2024-10-10T18:38:39","modified_gmt":"2024-10-10T18:38:39","slug":"zeldin-threat-passed-criminal-justice-reformers-ready-to-push-hochul","status":"publish","type":"post","link":"https:\/\/paperprisons.org\/news\/all\/news\/zeldin-threat-passed-criminal-justice-reformers-ready-to-push-hochul\/","title":{"rendered":"Zeldin Threat Passed, Criminal Justice Reformers Ready to Push Hochul (Nov. 11, 2022)"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">&#8221; Activists and experts say the newly elected first female governor of New York State has plenty of promises to deliver on when it comes to prisoner\u2019s rights and clemency.<\/h2>\n\n\n\n<p>BY&nbsp;<a href=\"https:\/\/www.thecity.nyc\/authors\/reuven-blau\">REUVEN BLAU<\/a>&nbsp;&nbsp;<a href=\"mailto:rblau@thecity.nyc\">RBLAU@THECITY.NYC<\/a><\/p>\n\n\n\n<p>After months of largely staying quiet during the unexpectedly competitive governor\u2019s race, not wanting to give fuel to her right-wing opponent, criminal justice reformers are now looking to push Gov. Kathy Hochul on a series of issues.&nbsp;<\/p>\n\n\n\n<p>Those include plans to press Hochul to support stalled legislation to ease parole release restrictions for elderly people behind bars based on individualized assessments and to streamline the sealing of criminal records that frequently make it difficult for individuals to move on with their lives, advocates and policy experts told THE CITY.&nbsp;<\/p>\n\n\n\n<p>They also want the newly elected governor to keep her word on&nbsp;<a href=\"https:\/\/www.governor.ny.gov\/news\/governor-hochul-grants-clemency-10-individuals-and-announces-formation-new-clemency-advisory\" target=\"_blank\" rel=\"noreferrer noopener\">drastically overhauling<\/a>&nbsp;the prisoner clemency process \u2014 and to start enforcing a legislative ban on solitary confinement that has been&nbsp;<a href=\"https:\/\/www.nysfocus.com\/2022\/09\/12\/halt-solitary-implementation-doccs\/\" target=\"_blank\" rel=\"noreferrer noopener\">routinely ignored<\/a>&nbsp;by the state\u2019s Department of Corrections and Community Supervision.&nbsp;<\/p>\n\n\n\n<p>\u201cWe want to promote healing and justice and investing in our communities,\u201d said Roslyn Smith, the Brooklyn community leader of&nbsp;<a href=\"https:\/\/rappcampaign.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Release Aging People in Prison<\/a>&nbsp;(RAPP).&nbsp;<\/p>\n\n\n\n<p>Smith and others note that the push for elder parole is a matter of life and death for some people behind bars who aren\u2019t eligible for early release for decades under the current system.&nbsp;<\/p>\n\n\n\n<p>The criminal justice reform wish list comes after Rep. Lee Zeldin, the Republican candidate for governor,&nbsp;<a href=\"https:\/\/www.thecity.nyc\/2022\/11\/8\/23448087\/hochul-zeldin-election-results-new-york\" target=\"_blank\" rel=\"noreferrer noopener\">spent months<\/a>&nbsp;on the campaign trail slamming Hochul for perceived spikes in crime \u2014 and what he argued was her inability to address it.&nbsp;<\/p>\n\n\n\n<p>Reformers and some political observers described those ultimately unsuccessful political attacks as \u201cfear mongering\u201d that should not be used to dictate her policy decisions over the next four years.&nbsp;<\/p>\n\n\n\n<p>\u201cI think her being re-elected is a sign that these are things that society wants, in the broadest sense,\u201d said political strategist Patrick Jenkins, a lobbyist who has worked for and with several local and state elected officials.&nbsp;<\/p>\n\n\n\n<p>Hochul and her press team did not respond to an email seeking comment. She rarely, if ever, talked about specific pending criminal justice reform legislation on the campaign trail.&nbsp;<\/p>\n\n\n\n<p>Talking to reporters at the annual&nbsp;<a href=\"https:\/\/www.thecity.nyc\/politics\/2021\/11\/4\/22764743\/nyc-politicians-in-puerto-rico-somos-governor-race-council\" target=\"_blank\" rel=\"noreferrer noopener\">Somos conference<\/a>&nbsp;in San Juan, Puerto Rico, Hochul said she\u2019d have \u201cconversations\u201d with legislative leaders \u201cabout the overall, comprehensive, strategy to deal with public safety.\u201d&nbsp;<\/p>\n\n\n\n<p>\u201cWe will continue our efforts on guns\u2026 the courts,\u201d she said. \u201cAnd I think this is the untold story here is we had two solid years of no jury trials.\u201d&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u2018I left So Many People Behind\u2019<\/h2>\n\n\n\n<p>For Smith, 60, the issue of elderly parole is personal.&nbsp;<\/p>\n\n\n\n<p>She spent 39 years in prison for a murder conviction and was&nbsp;<a href=\"https:\/\/www.thecity.nyc\/justice\/2019\/8\/16\/21210860\/longest-serving-woman-inmate-s-death-makes-her-case-a-cause\" target=\"_blank\" rel=\"noreferrer noopener\">released four years ago<\/a>&nbsp;after Brooklyn District Attorney Eric Gonzalez quietly moved to reduce her sentence.&nbsp;<\/p>\n\n\n\n<p>\u201cI\u2019m taking on doing this work because I left so many people behind languishing in prison, dying in prison,\u201d she said.&nbsp;<\/p>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/S15\" target=\"_blank\" rel=\"noreferrer noopener\">Elder Parole<\/a>&nbsp;<a href=\"https:\/\/thecity.nyc\/2019\/06\/prisoners-locked-out-of-state-criminal-justice-overhaul.html\" target=\"_blank\" rel=\"noreferrer noopener\">measure<\/a>&nbsp;would automatically grant parole hearings to all prisoners who have served 15 years or more when they turn 55. Criminal justice reformers point out that if passed, it would still not result in an automatic release of everyone eligible.&nbsp;<\/p>\n\n\n\n<p>The incarcerated people would need to be approved by a parole board, which is unlikely to release people convicted of multiple killings or other high-profile crimes \u2014 or if the person shows no signs of remorse and rehabilitation.&nbsp;<\/p>\n\n\n\n<p>The legislation was first introduced in 2018. Last year, Republicans were joined in their opposition to elder parole by some moderate Democrats, whose party controlled both houses of the state Legislature with veto-proof super majorites.<\/p>\n\n\n\n<p>Supporters of the legislation point out that one person in state prison dies every three days on average, records show. They also note that the majority of New Yorkers locked up are&nbsp;<a href=\"https:\/\/www.vera.org\/downloads\/pdfdownloads\/state-incarceration-trends-new-york.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">people of color<\/a>.&nbsp;<\/p>\n\n\n\n<p>Prisoner advocates also&nbsp;<a href=\"https:\/\/www.themarshallproject.org\/2015\/03\/20\/too-old-to-commit-crime\" target=\"_blank\" rel=\"noreferrer noopener\">point<\/a>&nbsp;to&nbsp;<a href=\"https:\/\/open.lib.umn.edu\/socialproblems\/chapter\/8-3-who-commits-crime\/\" target=\"_blank\" rel=\"noreferrer noopener\">multiple<\/a>&nbsp;<a href=\"https:\/\/www.sagepub.com\/sites\/default\/files\/upm-binaries\/60294_Chapter_23.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">studies<\/a>&nbsp;that indicate there\u2019s little risk that elderly prisoners will commit new crimes if paroled. About&nbsp;<a href=\"https:\/\/ucr.fbi.gov\/crime-in-the-u.s\/2016\/crime-in-the-u.s.-2016\/tables\/expanded-homicide-data-table-2.xls\" target=\"_blank\" rel=\"noreferrer noopener\">1.5% of murders<\/a>&nbsp;annually are committed by people who are 75 years and older.<\/p>\n\n\n\n<p>\u201cPeople need to be seen for who they are, after 15 to 20 years [in prison], people aged out of criminal activities,\u201d said Smith. \u201cThe rhetoric that\u2019s been put out is that everybody who comes home commits more crimes. But it\u2019s not true.\u201d&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Not So Patiently Waiting<\/h2>\n\n\n\n<p>Mayor Eric Adams \u2014 who has repeatedly blamed changes in the bail law as a primary culprit for crime \u2014 has not publicly taken a position on the Elder Parole measure and other reform proposals.&nbsp;<\/p>\n\n\n\n<p>A spokesperson for the mayor did not immediately respond to a request seeking comment.&nbsp;<\/p>\n\n\n\n<p>Other proposals where his office has stayed quiet include the&nbsp;<a href=\"https:\/\/www.cleanslateny.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Clean Slate Act<\/a>&nbsp;to \u201cmake record sealing much more accessible by automating the process,\u201d according to the Brennan Center for Justice, which&nbsp;<a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/why-new-yorks-clean-slate-act-essential-economic-justice#:~:text=The%20Clean%20Slate%20Act%20would,many%20as%201.4%20million%20people.\" target=\"_blank\" rel=\"noreferrer noopener\">supports the legislation<\/a>.&nbsp;<\/p>\n\n\n\n<p>It could assist up to 1.4 million people, according to&nbsp;<a href=\"https:\/\/www.paperprisons.org\/states\/NY.html\" target=\"_blank\" rel=\"noreferrer noopener\">one estimate<\/a>&nbsp;by the&nbsp;<a href=\"https:\/\/paperprisons.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Paper Prisons Initiative of Santa Clara University.<\/a><\/p>\n\n\n\n<p>As for clemency, shortly after Hochul first took office \u2014 following Andrew Cuomo\u2019s scandal-scarred resignation \u2014 she promised to overhaul the system by adding more staff to review applications and to create an advisory panel.&nbsp;<\/p>\n\n\n\n<p>But the panel has never been formed and, aside from&nbsp;<a href=\"https:\/\/www.governor.ny.gov\/news\/governor-hochul-grants-clemency-10-individuals-and-announces-formation-new-clemency-advisory\" target=\"_blank\" rel=\"noreferrer noopener\">nine pardons and one commutation<\/a>&nbsp;the day of her announcement, nothing has been done.&nbsp;<\/p>\n\n\n\n<p>Some advocates and political observers believe that she has been waiting until after the election.&nbsp;<\/p>\n\n\n\n<p>\u201cFrom my perspective, an election should have no impact&nbsp; on whether someone merits clemency,\u201d said Steven Zeidman, director of the&nbsp;<a href=\"https:\/\/www.law.cuny.edu\/academics\/clinics\/defenders\/\" target=\"_blank\" rel=\"noreferrer noopener\">Criminal Defense Clinic at the CUNY School of Law<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>He hailed the added state staff set to review the&nbsp;<a href=\"https:\/\/www.thecity.nyc\/2020\/12\/22\/22196558\/prisoners-hoping-for-mercy-place-little-faith-in-cuomo\" target=\"_blank\" rel=\"noreferrer noopener\">thousands of pending cases<\/a>&nbsp;but cautioned that it would make no difference unless Hochul took more aggressive action.&nbsp;<\/p>\n\n\n\n<p>\u201cIs there going to be regular, ongoing, clemency?\u201d he added. \u201cUntil that happens that\u2019s a disappointment.\u201d<\/p>\n\n\n\n<p>One issue that doesn\u2019t need a legislative fix is limits on solitary confinement in all lockups throughout the state.&nbsp;<\/p>\n\n\n\n<p>Hochul signed the&nbsp;<a href=\"https:\/\/www.nyclu.org\/en\/legislation\/humane-alternatives-long-term-halt-solitary-confinement-act\" target=\"_blank\" rel=\"noreferrer noopener\">Humane Alternatives to Long-Term (HALT) Solitary Confinement<\/a>&nbsp;Act back in March.&nbsp;<\/p>\n\n\n\n<p>That measure bans people from being held in solitary confinement for more than 15 straight days, or 20 out of 60 days.&nbsp; Prison officials are also blocked from using solitary for people with disabilities or mental health issues, according to the new law.&nbsp;<\/p>\n\n\n\n<p>But state prisons have been ignoring the new regulations, with four in 10 people in solitary with listed mental health care needs, according to a&nbsp;<a href=\"https:\/\/www.nysfocus.com\/2022\/09\/26\/prisons-are-illegally-throwing-people-with-disabilities-into-solitary-confinement\/\" target=\"_blank\" rel=\"noreferrer noopener\">report by New York Focus<\/a>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Prison Boss Hold Up<\/h2>\n\n\n\n<p>Meanwhile, the state Senate has&nbsp;<a href=\"https:\/\/www.hudsonvalley360.com\/news\/nystate\/doccs-chief-nomination-hits-a-snag\/article_c2f6927d-0dc5-5caa-b8ab-e6a2df185992.html\" target=\"_blank\" rel=\"noreferrer noopener\">refused to confirm<\/a>&nbsp;DOCCS\u2019 acting commissioner, Anthony J. Annucci, citing his inability to overhaul the department during his nine-years in leadership roles.&nbsp;<\/p>\n\n\n\n<p>Advocates and criminal justice experts want Hochul to appoint a new, more reform-minded, commissioner. Annucci recently&nbsp;<a href=\"https:\/\/spectrumlocalnews.com\/nys\/central-ny\/news\/2022\/09\/27\/rallies-call-for-an-end-to-prison-package-restrictions\" target=\"_blank\" rel=\"noreferrer noopener\">limited the types of packages<\/a>&nbsp;for prisoners to just a few private firms \u2014 as part of a crackdown on contraband. Family and friends are no longer allowed to personally bring items to prisons.&nbsp;<\/p>\n\n\n\n<p>\u201cHe\u2019s bringing us back to a pre-Attica period with the oppressive and Draconian rules he\u2019s putting in place,\u201d said Jerome Wright, the co-director of the Halt Solitary campaign. \u201cHe needs to be replaced before we have an Attica 2.0 situation on our hands.\u201d&#8221;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.thecity.nyc\/2022\/11\/11\/23452195\/zeldin-ny-justice-reform-push-governor-hochul\">Read original post.<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>&#8221; Activists and experts say the newly elected first female governor of New York State has plenty of promises to deliver on when it comes to prisoner\u2019s rights and clemency.
